As Your Notary Signing Agent, The Following Notarial Acts Can Be Performed:

  *Acknowledgments*
Properly identify who you are and that you willingly signed a document. The document does not physically need to be signed in the presence of a notary.

*Jurats*
Properly identify who you are, witness you signing a document, and administer an oath or affirmation that the information in the document is accurate.

*Oaths and Affirmations*
Properly identify you and verbally administer an oath or affirmation that you have told the truth. This can be completed along with written documents or only orally.

   *Signature Witnessing*
Properly identify who you are and witness you signing a document.

   *Copy Certification*
Certify that a copy looks exactly like the original by observing a copy made of an original document or examining the copy compared to the original.

To schedule an appointment, the following will be needed:

A valid government-issued identification that includes your name, photo, signature, and expiration date, such as a driver's license, ID card, passport, military ID, or government-issued work ID.

All individuals who need their signatures notarized must be at the appointment.

You need to give at least 30 minutes of your undivided attention for general notarizations. Appointments typically take 10 - 30 minutes, depending on the number of documents to be notarized.

At least 1 hour of your undivided attention is needed for loan signings and a clear table to complete the paperwork. Please be aware that loan signings can sometimes take over an hour, depending on any issues or questions that may arise and the size of the loan package, which can vary from as small as 20 pages up to 300 pages that need to be reviewed, signed, and notarized.

Frequently Asked Questions About A Notary

What is a notary?

An individual of integrity commissioned and appointed by the state to be a public official who assists with reducing fraudulent acts within documents and protecting involved individuals by being an unbiased witness.

The notary must properly identify any individual requesting a document notarized in person, verify that signatures are genuine, and that the involved individuals signed the documents willingly.

What a notary is NOT legally able to do?

Unfortunately, notaries are not allowed by law to give any advice on which notarial act you should choose. Here are the descriptions of what each type of notarial act means to help you with making your decision:

Acknowledgment - Declares that you willingly signed a document. It does not require the document to be signed in the presence of a notary, but you will be asked if you willingly signed the document once you meet with the notary.

Jurat - You are swearing or affirming that the information in your document is accurate and will be required to sign the document in the notary's presence.

Oath - Verbally promising to tell the truth while pledging to God or a supreme being.

Affirmation - Verbally promising to tell the truth on a personal level without pledging a higher power.

Notaries are also not allowed to:

Give any legal advice or assist in preparing legal documents in any way. Suppose an individual is unsure about information stated in a document. In that case, a notary can only point out information that may answer the question already listed in the document or can direct the individual to contact the party requesting the notarized document to answer more detailed questions.

Perform notarizations without the individual physically present or if the person signing does not seem competent, aware, or under duress, causing them to unknowingly or involuntarily sign their signature on the documents.

Notarize documents that have blank spaces or are not fully completed to avoid unverified information being filled in later after being notarized.

What are some common types of documents that require a notarization?

Legal documents
Wills, trusts, advanced directives, affidavits, executorships, custody and guardianship agreements, power of attorney, marriage license applications, certificates of divorce, court documents, etc.

Business documents
Employment contracts, commercial leases, construction and loan agreements, vendor contracts, etc.

Financial documents
Financial statements, loan documents, mortgage closing documents, property deeds, credit documents, liens, motor vehicle bills of sale, etc.

General notarization process performed by the notary:

1) Physically meet the signer face to face to verify the appropriate identification for accuracy.

2) Review the documents to ensure they are complete, there are no missing pages, and all the individuals needing their signatures notarized are physically present to sign. (If any individuals needing their signatures notarized are not present at the appointment, that individual's name will need to be crossed out and initialed by the notary.

3) Record the notarization in a notary journal using the signer's identification to fill in the required fields and have the journal signed by all individuals having their signature notarized.

4) Fill in the documents' notary areas (generally at the bottom of the document to be notarized), and sign and seal all documents that require notarization with a notary stamp.

General notarizations usually take 10 - 30 minutes, depending on how many documents are notarized.

Frequently Asked Questions About A Signing Agent

What is a signing agent?

A notary who has completed special training on properly explaining loan documents to clients and conducting loan closings for the mortgage finance industry. Maryland requires an additional title producer license to handle most loan documents.

A signing agent will not only ensure that the clients have a brief understanding of the loan documents before agreeing and signing but will also ensure that the paperwork is returned for processing promptly.

What a signing agent is NOT legally able to do?

Signing agents cannot answer any "why" questions during loan closings but can direct clients to where in the documentation they can find the answers they are looking for or direct them to contact the lenders for more details. Signing agents can only explain the general description of the loan documents, and no advice can be given.

What are some common types of loan documents packages that require a signing agent?

Refinances
Purchase of a new home
Selling your home
Loan modifications
Home equity lines of credit
Reverse mortgage
Commercial loans
VA loans
Mortgage Forbearance
